Privacy Policy

This Privacy Policy applies to MotusNEX websites, applications, portals, reports, communications, billing, support, integrations, and related services.

MotusNEX is designed primarily for business customers, and much of the information processed through the Service is submitted by or on behalf of subscribing businesses.

We may collect:

• job title;
• company name;
• business address.

Business and carrier information

• DOT and MC numbers;
• carrier information;
• fleet information;
• customer and broker information;
• business preferences.

Vehicle and equipment information

• trucks;
• trailers;
• VINs;
• unit numbers;
• maintenance;
• fuel;
• route;
• mileage information.

Driver and personnel information

• names;
• contact information;
• assignments;
• operational records;
• uploaded documents.

Financial and operational information

• revenue;
• expenses;
• receipts;
• statements;
• invoices;
• load information;
• payment status;
• pricing;
• profitability information.

Uploaded content

• documents;
• images;
• spreadsheets;
• PDFs;

Billing information

Payment-card information is generally collected and processed by Stripe. MotusNEX may receive transaction identifiers, payment status, plan information, limited payment-method information, and billing records.

Automatically collected information

• browser and device information;
• IP address;
• operating system;
• logs;
• diagnostic information;
• approximate location;
• usage events;
• timestamps;
• pages and features used;
• performance or error information;
• cookies and local storage used for login, security, preferences, and functionality.

We may use information to:

• operate and provide MotusNEX;
• authenticate users;
• administer accounts;
• provide customer support;
• process subscriptions and payments;
• calculate metrics and reports;
• provide mileage, profitability, and operational information;
• generate AI-assisted summaries and insights;
• personalize settings;
• send transactional, security, billing, and account communications;
• prevent fraud and abuse;
• investigate security incidents;
• troubleshoot technical problems;
• comply with legal obligations;
• enforce agreements;
• improve the Service;
• create aggregated or de-identified analytics where permitted.

For information submitted by a Customer concerning its drivers, employees, contractors, customers, brokers, vehicles, or business operations, MotusNEX generally processes that information on behalf of the Customer.

The Customer is responsible for determining what information is submitted and for providing any required notices, permissions, or consents.

MotusNEX may act independently for account administration, security, billing, legal compliance, fraud prevention, and our own business operations.

We may disclose information:

• to authorized users according to Customer permissions;
• to vendors and service providers supporting MotusNEX;
• to professional advisers, auditors, insurers, lenders, or transaction participants subject to appropriate confidentiality obligations;
• when required by law, court order, or lawful governmental request;
• where reasonably necessary to protect safety, security, rights, or prevent fraud;
• in connection with a merger, financing, acquisition, reorganization, or sale of assets;
• where the Customer directs or consents to disclosure.

We do not sell Customer Data for money.

We do not use Customer Data for third-party targeted advertising.

Service providers may include:

• AWS — infrastructure and hosting;
• Supabase — database, storage, and authentication;
• Stripe — payment processing;
• Postmark — transactional and inbound email;
• Google Maps / Routes — mapping and mileage functionality;
• OpenAI — AI-assisted features;
• Sentry — error monitoring;
• Google Workspace — company communications.

Providers may change as the Service develops.

When an AI-enabled feature is used, relevant Customer Data may be transmitted to an AI service provider as necessary to produce the requested result.

Customers should avoid submitting unnecessary sensitive information and must have lawful authority to submit the information they provide.

AI-generated output may be inaccurate and should be independently reviewed.

MotusNEX may use essential cookies, local storage, and similar technologies for:

• login;
• authentication;
• security;
• session management;
• user preferences;
• functionality;
• performance;
• analytics.

Where legally required, MotusNEX will provide applicable consent or opt-out mechanisms.

We retain information for as long as reasonably necessary to:

• provide the Service;
• maintain accounts;
• fulfill the purposes described in this Privacy Policy;
• comply with legal, tax, accounting, security, and contractual obligations;
• resolve disputes;
• prevent fraud;
• enforce agreements.

Retention periods vary depending on data type, account status, Customer instructions, backup cycles, and legal requirements.

After account termination, information may remain available for a limited export period and may later be deleted or de-identified unless retention is reasonably necessary for legal, security, billing, or operational purposes.

We use administrative, technical, and organizational safeguards designed to protect information.

These may include:

• authentication;
• access controls;
• encryption in transit;
• provider security controls;
• logging;
• restricted access;
• monitoring.

No system can be guaranteed completely secure.

Customers are responsible for protecting credentials, managing user permissions, securing devices, and promptly removing unauthorized users.

MotusNEX is operated from the United States, and information may be hosted or processed in the United States through our service providers.

Users accessing MotusNEX from outside the United States understand that information may be transferred to and processed in jurisdictions with different privacy laws.

Depending on applicable law, individuals may have rights to request:

• access;
• correction;
• deletion;
• portability;
• restriction;
• information concerning processing;
• opt-out of certain legally regulated data uses.

We may verify identity and authority before responding.

If a request concerns information controlled by a business Customer, we may direct the requester to that Customer or assist the Customer as required by law or contract.

We will not unlawfully discriminate against individuals for exercising applicable privacy rights.

Residents of certain U.S. states may have privacy rights under applicable state privacy laws.

Where applicable, these may include rights to know, access, correct, delete, obtain a copy of personal information, or opt out of certain processing.

MotusNEX will respond to valid requests as required by applicable law.

MotusNEX is not directed to children under 18.

We do not knowingly permit minors to create MotusNEX accounts.

Customers should not submit a minor’s personal information unless they are legally authorized to do so and the information is legitimately required for business purposes.

We may send account, billing, service, verification, security, policy, and transactional communications.

Transactional communications may be necessary while an account is active.

Marketing communications, if sent, will include legally required opt-out methods.

We may update this Privacy Policy to reflect legal, operational, provider, security, or Service changes.

We will post the updated version and revise the effective date.

Where required, we may provide additional notice of material changes.
